Terms of Use

These Terms of Use ("Terms") govern your access to and use of Ember, a consent-based, read-only threat-monitoring service run by SMOKE Intelligence Services ("SMOKE", "we", "us"), including this website and the Ember application. By using Ember, you agree to these Terms and to our Privacy Policy.

YouTube. Ember uses YouTube API Services. By using Ember, you agree to be bound by the YouTube Terms of Service. Google's use of information is governed by the Google Privacy Policy.

1. The service

Ember reads the comments and mentions coming into the accounts you connect, scores each one for threat type and severity with a private AI, tracks the actors behind them, and alerts you when something escalates. Ember asks for read-only access. It never posts, edits, deletes, or otherwise acts on your accounts.

2. Consent and eligibility

You may connect and monitor only accounts you own or are authorized to manage, and only with the account holder's consent. You must be at least 18 and able to enter a binding agreement. You are responsible for the accuracy of the access you grant and for keeping your credentials confidential.

3. Acceptable use

Do not use Ember to harass anyone, to surveil third parties without authorization, or for any unlawful purpose. Do not misuse, resell, reverse engineer, or overload the service or the APIs behind it, including the YouTube API Services. You agree to follow the YouTube Terms of Service along with all applicable platform policies and laws.

4. Not a guarantee of safety

Ember is a monitoring and early-warning service. It cuts risk and shortens your response time, but it does not guarantee safety and is not a substitute for law enforcement or emergency services. In an emergency, contact your local authorities. Priority-response commitments and the handling of suspected illegal content are covered by a separate service agreement.

5. Data

How we collect, use, store, share, retain, and delete data, including data from Google and YouTube API Services, is set out in our Privacy Policy. You can revoke access and request deletion at any time, as described there.

6. Fees

Paid plans, add-ons, and billing terms are set out in your order or service agreement with SMOKE. If those terms and these Terms ever conflict on fees, the order or service agreement controls.

7. Disclaimers & liability

Ember is provided "as is" to the fullest extent the law allows. To the extent the law allows, SMOKE is not liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot be limited under applicable law.

8. Changes & termination

We may update these Terms from time to time. When we do, we will change the "Last updated" date, and for material changes we will notify active clients. You can stop using Ember and disconnect your accounts at any time. We may suspend or end access for a breach of these Terms or of the YouTube Terms of Service.
